Do I have a case of negligence against my neighbor for his tree falling in my yard?

My neighbor’s 80′ tree fell onto my property destroying 2 cars, a 40′ tree, a shed full of equipment, part of my fence part of my roof. My insurance will pay for most of the costs, but not for my old truck (no comp/collision) or my 40′ tree. My insurance said I must get the money from my neighbor’s insurance.

Here are some facts: My neighbor has had construction going on in his backyard for 5 months. He had a 60′ tree cut down and the stump ground up that was planted next to the tree that fell. He had a fence constructed near the trees and the roots were cut to make way for the fence. He had tons concrete and dirt removed with a bobcat that used a pathway over the roots of the trees. People trapsed over the roots day in and day out and they dug trenches to reroute pipes to yard where the trees are.

Do I have a case for negligence? All I want is the cost of the truck, tree and any out of pocket expenses I incur ($5000). My neighbor insists he is not culpable.

What policy would this cover?

A large tree was installed on a jobsite and it fell over in a wind storm. The tree crashed through the neighbor’s home and the fence on the property. The home is still under construction and therefore has no homeowner’s policy, but there is a builder’s risk policy for this project. The insurance company is not going to cover the damage to the house but they will cover the tree. Should the general liability policy cover the damage to the house???

What happens if your house is destroyed? Can you build bigger on the same land?

This is one of those hypothetical questions that my over-inquisitive mind thought of after we were issued a tornado watch this evening. Our house is tiny, and we really want a bigger house. But the problem is that my husband bought this house two weeks before we met, he had never bought a house before, and his family didn’t help or give him any advice, so he got taken. He overpaid by at least $15K. Oh, and they suckered him into a no appraisal loan and he didn’t know any better.

So I was thinking what would happen if the house was hit by a tornado (or otherwise destroyed)? Would the insurance company pay off the mortgage company and give us the small amount by which our insurance exceeds our mortgage? At which point we could just get a construction loan and build the house we want here on this land.

Or would the insurance company issue us a check with which to rebuild, and we would just keep paying the same mortgage?

I’m translating the general terms and conditions of a travel insurance policy from Dutch into English and there’s an expression I just have no idea how to translate. I have two existing versions in front of me:

One says : You may terminate the insurance policy by process-server…

The other one goes like this: The contract may be terminated by a process served by a bailiff…

I’m guessing it also depends which English Speaking country you’re living in.. but at this point I’m just concerned with finding one that’s correct :-p
Neither construction seems to get many hits when I google them and I can’t find the word I need in my trusty dictionary :-p

Nationwide has denied my homeowners insurance claim-what can I do next?

After hurricane Ike hit, we came home to a bent ridge beam, walls bowed out, and siding that was pulled away from the house (not to mention alot of little stuff out of whack here and there.) Nationwide sent an engineer out to inspect and she sent them a report saying that we had faulty construction. Now they are denying our claim. I’m so angry and I don’t know what to do next! All I know is that my home doesn’t look the same as it did before Ike hit. Our home was built in the 70’s and built to code at that time. Can someone please give me some advice?

What does not in compliance mean for a health insurance company?

We both lost our jobs due to the economy and are now self-employed trying to raise our family of five on low-income wages. I was a teacher, he was in construction, this is not what we planned but life happens. We took at least a 50% paycut and lost our health insurance.

We privately purchase high deductible HSA health insurance through BCBS. It seemed like the responsible thing to do. Our deductible is $5k and our max out of pocket is $11k. We will be out around $7k this year. I was told to negotiate with the hospital and doctors. However, they told me they could not negotiate because it was not in compliance. They said they used to be able to cut rates but now they can’t -they have to notify the insurance company in writing if they do. I’ve called the hospital billing people, I’ve called BCBS, I’ve tried to figure out what this compliance issue is and where it comes from -what document, what language? The hospital billing people didn’t know and BCBS gave me the run-around.

What I can gather is that BCBS will not let the hospital give us a discount because then THEY would also want the same discount. This seems crazy to me! Why would they care if we are paying our premiums The hospital takes the hit, not them. Maybe I’m wrong.

Does anyone know what they mean or where this comes from. Nobody can answer my question. We just don’t have the money. We might be able to pay on it month by month but anything can happen at anytime. I can’t be assured that I’ll still have my job or my husband won’t break his arm and not be able to work…I just can’t.

Frustrated! -But if anyone could help me with what this compliance thing is, I’d greatly appreciate it.

Will the fact that I am behind on my mortgage have any affect on my homeowners insurance claim?

My home was severely damaged recently during a storm. A straight line wind blew a huge tree into our house which took out our wrap around porch completely. The roof was also damaged as well as some interior walls. The claim is in excess of $20,000. I’m worried about my bank releasing our check from the insurance company because we are behind on our payments, about 60 days. I’m in sales (new Chrysler products of all things) and my husband is a land surveyor (there’s not a lot of new construction going on these days). Needless to say, it’s been really tough to keep up lately. Will we have any trouble getting the funds released to do the repairs? Will our delinquent payments just be taken out of the insurance money? Anyone knowledgeable about such matters please advise. Thank you.

the tiles in our house are popping up? Is this something that would be covered under home owners insurance?

WE bought the house last year, and since the purchase (which was a short sale, as is) the tiles )which are large ceramic tiles) have been popping up all over the place, cracking, and seperating. We were told that the glue that was used to secure them was bad, and so now I dont know what we can do except spend $$$$ having the entire thing replaced. It hardly seems fair, and I was wondering if homeowners insurance covers something like this? We have tried to contact the company that built the house, and they refuse to return our calls (Lucas Construction in Vero Beach, FL). I wondered, has anyone got information on what we should do? It is getting dangerous around here!

what type of lawyer would handle a claim against a homeowners insurance co, for a claim that was denied?

Under insured location in our policy, it clearly spells out a definition as a residence under construction to be used as a primary residence for the insured, which this was. But the insurance co comes back with a denial, saying that it is not the intent of the policy to cover such a loss. I have been over and over the policy, and I feel sure that if sued, they would cover, but as we don’t have the cash up front, we would like a lawyer that would take it on contingency.
the loss was wind damage. We are doing the work ourselves, little by little, so no contractor, and the policy speciffically says that it is an insured location. The only part of the policy they quoted was coverage for the residence premisis, and did not deal with the insured location part. NY insurance dept does not handle disputes over coverage.

DO YOU HAVE TO PAY DOWNPAYMENT EVERY YEAR TO RENEW COMMERCIAL LIABILITY INSURANCE. IF SO WHY? IF NOT WHY?

This is our second year with our construction business . last year when it was time to renew our liability insurance the broker snookered us into a 700.00 down payment because she said they weren’t doing business with our insurer anymore, so we paid and continued with monthly payments on time, now it’s time to renew and they want another 600. IS this right? do i have to use a broker? please help !I don’t have that kind of money to give up within the next 30 days like they want. also they gave us no warning, they sent me a renewal email last week asking if anything had change ,and did we want to add or remove any coverage, i responded no to all, and then i get this letter in the snail mail, telling me i owe if i want to continue coverage . i agree with still making monthly payments, but why another down payment when there are no changes to my policy?
